These Terms and Conditions govern the sale and use of the Ticket(s) issued by SJM RESORTS, S.A. (“SJM” or “We”). By purchasing, possessing or using a Ticket, the purchaser/ bearer/ user of the Ticket (“You”) understand(s) and agree(s) to comply with these Terms and Conditions.

1.    For the purpose of these Terms and Conditions,

a. “Event” means an entertainment event, concert, exhibition, sport, tour, seminar, trade show, theatrical or musical performance event to be held at the Venue in respect of which we have the right to sell You the Ticket(s).

b. “Event Partner” means any party involved in the provision of the Event, such as a Promoter, Venue owner/operator, performer or producer.

c. “Promoter” means the person, business or company staging the Event if different from us.

d. “Ticket(s)” means printed, electronic or other type of evidence (including a wristband) of the right to attend an Event.

e. “Venue” means any facilities or locations of any nature where the Event is being held.

2.    Ticket may not, without the prior written consent of SJM or the Promoter, be resold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a Ticket is sold or used in breach of this condition, the Ticket may be cancelled without a refund and the bearer of the Ticket may be refused admission. Entry may be refused if tickets are damaged, defaced, forged or copied in any way or are not purchased from SJM or other authorized points of sale.

3.    It is Your responsibility to check the details of Your Ticket(s) carefully, mistakes cannot be rectified after purchase.

4.    No refunds, exchanges or cancellations on any Ticket is permitted unless an Event is postponed or cancelled in which case a Notice of Cancellation or Postponement will be placed in the media by the Promoter or SJM. 5.    All prices are in MOP and subject to applicable taxes.

6.    Travel to and from the Venue is Your responsibility, therefore no refunds, exchanges or cancellations will be permitted due to the alteration, late arrival, unavailability, postponement or cancellation of travel services by Land, Air or Sea.

7.    The right is reserved to add, withdraw, reschedule or substitute artists and / or vary advertised programs, prices, venues, age restrictions, seating arrangements and audience capacity.

8.    The right is reserved to charge a fee for the replacement of Tickets. SJM reserves the right not to replace tickets where seating is not allocated (general admission tickets) or if purchase details cannot be verified.

9.    The right of admission is reserved and all ticket holders are subject to:

a.       Conditions of Entry of SJM, the Event Partner, Promoter and Venue;

b.      the latest rules and guidelines issued by the Macau Government regarding COVID-19; and

c.      applicable rules and regulations.

10.    General terms and conditions across all Events:

a.       You must be able to produce acceptable proof of name and age.

b.       You may be subject to security checks upon entry into the Event.

c.       Any items deemed to be dangerous or inappropriate by SJM, Event Partner or Promoter are prohibited. Prohibited items must be removed from the Venue or discarded. Unlawful items and the person in possession of those items will be handed over to the police.

d.       You may be refused entry or ejected for behavior deemed inappropriate.

e.       Late arrival may result in non-admittance.

11.    Cameras, audio and video recorders are not permitted inside the Venue, unless previously authorized by SJM, the Event Partner(s) or Promoter(s). The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data inside any Venue is strictly forbidden. Unauthorized recording equipment, recordings, tapes, films or similar items may be confiscated and destroyed or deleted.

12.    By entering the Venue, You consent and authorize SJM, Event Partner and Promoter to photograph, film, videotape, record, or reproduce your likeness, image and/or voice for any purpose without any payment or consideration.

13.    Possession of a Ticket does not confer any rights on You to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the Ticket.

14.    Any Ticket cannot be used for advertising, promotions, contests or sweepstakes, unless formal written permission is given by SJM, Event Partner(s) or Promoter(s).

15.    You agree not to obtain or attempt to obtain any Ticket(s) through bot programs, other similar methods or any other illegal or unauthorized activity. We reserve the right to cancel any Ticket which we reasonably suspect to have been made in breach of these Terms and Conditions without any notice to you. Any and all Ticket(s) purchased as part of such transaction will be void.

16.    You shall indemnify and hold SJM, Event Partner(s) or Promoter(s) harmless against all actions, claims, and demands by any person who suffers or sustains any injury, loss, damage, to property or person, or death arising from or as a result of your negligence or willful misconduct.

17.    To the fullest extent permitted by applicable laws, You expressly waive all rights to seek any indirect, incidental, consequential, special or other damages arising out of or relating in any way to the Terms and Conditions, the Ticket and/or the Event.

18.    To the fullest extent permitted by applicable laws, We, the Event Partner(s) and Promoter(s) will not be responsible for any loss, injury or damage to any person or property howsoever caused, including but not limited to: (a) in any circumstances where there is no breach of a legal obligation owed by us, the Event Partner(s) or Promoter(s); (b) in circumstances where such loss or damage not resulting from negligence of us, the Event Partner(s) or Promoter(s); or (c) to the extent that any loss or damage results from breach by You of any of these Terms and Conditions and/or any applicable terms and conditions and rules and regulations and/or (d) any loss or damage results from Your negligence.

19.    SJM reserves the right to amend the Terms and Conditions without prior notice.

20.    Macao law shall govern the sale and use of all tickets and you agree to submit to the exclusive jurisdiction of the Macao courts.

21.    You acknowledge that You have reviewed the Terms of Use and Privacy Policy available at https://www.sjmresorts.com and agree with its terms.

22.    You authorize SJM to process, including to collect, use and store Your personal data for the purposes of the Event, to administer your purchase of Tickets and for direct marketing. We may transfer your personal data to our service providers including payment agents, telecommunication or computer service agents to enable us to process the purchase and delivery of Tickets. You have the right to request access to and correction of information held by us about You. The English version of these Conditions shall prevail wherever there is a discrepancy between the English and the Chinese versions.
